The driver said she looked away to adjust her radio volume and when she looked up it was too late. The lower rear bumper was ripped away from car and there is paint transfer below the license plate.
When the Deputy was done with writing up the accident report he walked over and handed me my papers, license, and accident report number, saying I could leave. I noticed as I pulled away he was walking the individual who hit me to his squad car. A few hours later the Deputy called me to let me know the driver was arrested for driving under the influence, they has admitted to smoking marijuana before leaving the house this morning. I live in Indiana where neither medical or recreational use is legal.
No one was hurt, which is what matters the most. Still very upsetting that someone's stupid decision damaged my car and now I have the extreme inconvenience of having to deal with getting it repaired. I have no idea the availability of OEM body parts in the USA.
Glad you're OK. As I tell everyone who's been in an accident which was not their fault, be sure to go after her insurance company for "diminished value" . If your Genesis is repaired and not totaled, your trade in/resale value will drop likely in the range of several thousand dollars because of the accident showing on Carfax. You may have to get a lawyer that specializes in DV because insurance companies HATE paying that part of a claim. Since the driver was under the influence your chances are better for the claim. If you give your Genesis dealer the hypothetical value reduction question, you can get a ball park estimate of how much you'll lose on your trade value. The impact was not that hard. Two body shops have inspected the vehicle and not found any frame damage.So glad you are safe. I have a question if you don’t mind. How did the car handle the impact? I would think the frame is bent. Did your airbags work? Take care of yourself because injuries appear later after being rear ended.
